The former personal attorney for Donald Trump has stepped down as New Jersey's top federal prosecutor. This follows a legal ruling that challenged her eligibility to serve.
Official Departure
The head of the Justice Department, Pam Bondi, announced her stepping down on the start of the week. Bondi stated that the court's "flawed" ruling made it unworkable for Habba to perform her duties.
"Do not interpret following the order as giving up," she declared. "The effort will now extend throughout the nation."
Judicial Challenge
The departure follows closely on a federal appellate panel ruled that she had been serving in violation of the law as the federal prosecutor. This decision is expected to impact scores of prosecutions in the Garden State.
The court ruled that a acting appointment that skirted the advice and consent of the Senate breached the Federal Vacancies Reform Act.
Future Role and Reaction
Bondi said that Habba will stay on at the justice department as a high-level advisor. She will pursue additional appeals of the disqualification, in the hope of achieving a overturned decision.
On a social media platform, she argued that the judiciary "should not be able to override the President's choice of prosecutors tasked with executing the executive branch's core responsibility of enforcing the law."

Background and Previous Role
Habba, originally became part of Donald Trump's lawyers in 2021. She went on to defended the former president in his hush-money trial in the previous year, leading to his conviction on multiple felony counts of financial record manipulation.
Prior to Habba took on the role of US Attorney, Donald Trump had revealed he was selecting her as his presidential counsellor during his second administration, labeling Habba as "unwavering in her loyalty" and a "tireless advocate for justice".
